INFO ON RIGHT OF WAY CLEARING

(This is in response to a comment on the prior post concerning the recent clearing related to the power line right of ways in Apple Creek.  Explore the link provided below to find any answers to questions you may have.  Any concerns or complaints need to be sent to Duke Energy as we have no say so in any of this.  Standard practice, at least here in NC.)

As I understand it, in NC Duke has the right to clear any right of way for all power line transmissions, to a distance that meets their safety standards, on anyone's property.  They do some limited clean-up, but most smaller branches and such  are left behind; in the case of emergency clearings, property owners are responsible for the clean-up.

If you still have questions or concerns, you need to contact Duke Energy directly as Apple Creek has no say so whatsoever about this operation.

  1. I understand what you are saying about Apple Creek having no say related to how much is cleaned up but at this point I have a slightly different concern. My concern started a couple days ago in the later afternoon when I heard the beeps of a vehicle backing up above my home (which would be just below one of the hairpins). I looked through the trees and could tell that it was an Asplundh truck dumping something. After they had left I drove up to the spot and discovered they had apparently been dumping mulched wood from trees and that appeared okay to me. What concerned me was the spot they were dumping them into which is actually on my neighbor's property and not mine. It appears that a tree or something was removed from that spot because now there is nothing between the edge of the pavement and quite a drop down into the trees. I don't think that was the situation before. That is where the mulch was being dumped but it hasn't filled much, if anything, in. We (Apple Creek Acres) have been left with a safety issue that is at least two-fold. First, I'm not sure whether there is enough remaining support for the pavement when a car has to go near the edge because of a passing car. Secondly, if a car has to go off the pavement because of a passing car or even because of slippery roads, there doesn't appear to be any support for that car and the possibility exists that the car might tumble at that point into the trees. Again....not my property.....but just a general concern fabout a possible safety issue that I think Asplundh may have caused and that we, as an association, need to address with them ..... or plan our own remedial effort .... to prevent a problem in the future.

    Just wanted to reply to the concerns of Lynn Damon concerning the tree work from an association standpoint.
    1. The curve above her house had no trees removed close to the road which would increase the existing safety/ erosion issue in this area.
    2. This is one of several areas on our road where we have erosion issues of the road bank.
    3. After consulting with our paving contractor, who said it would be a great idea, I asked the Asplundh Supervisor to dump the wood chips onto the road banks (ACAHA right of way) I identified with erosion issues. This will help stabilize eroded road banks at NO COST TO THE ASSOCIATION!
    4.In the future, it would be prudent for residents to contact the ACAHA Board before becoming so bothered and making uninformed comments concerning the road.

  3. Ahh.....I had looked for the email address for the ACAHA board first but couldn't find it (quite possibly my mistake) and so I voiced my concerns in the only place that seemed easily available. I posted it here because I felt I could receive an answer here...... and I did. Thanks to Keith for the response.....and I too love things that can help at no costs, although when/if there are safety issues, I am also okay with our spending $$.....
